Terms of Service

These Terms of Service (“Terms”) govern your use of the Thymesis iOS application (the “App”), published by Topic Technologies (“we”, “us”, “our”). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Licence

Subject to these Terms and Apple's Licensed Application End User License Agreement (EULA), we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on Apple devices that you own or control, for your own business and personal networking use.

2. Your responsibilities

  • You are responsible for the data you capture and store, and for keeping your own backups.
  • You will scan and store only information you are entitled to collect, and you will handle the personal data of others lawfully — including obtaining any consent required where you operate.
  • You will not use the App for any unlawful purpose, or to send unsolicited communications in breach of applicable law.
  • You will not reverse engineer, decompile, or attempt to extract the source code of the App except where permitted by law.

3. Card recognition & accuracy

Card recognition uses on-device machine learning provided by Apple Intelligence. Recognition is provided on a best-effort basis and may contain errors. You are responsible for reviewing and correcting captured details before relying on them. The App's availability of on-device AI depends on your device and iOS configuration.

4. Intellectual property

The App, its design, and the Thymesis and Topic Technologies names and marks are owned by Topic Technologies and its licensors. These Terms do not grant you any rights in our trademarks or branding. The content you create remains yours.

5. Third-party services

The App integrates with Apple system features including Contacts, Reminders, Mail, Maps, the camera, the photo library and iCloud. Your use of those features is governed by Apple's terms and privacy policies. We are not responsible for Apple services.

6. Disclaimer of warranties

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that recognition results will be accurate.

7. Limitation of liability

To the maximum extent permitted by law, Topic Technologies will not be liable for any indirect, incidental, special or consequential damages, or for any loss of data or profits, arising out of your use of the App. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Changes & termination

We may update the App and these Terms from time to time. Continued use after changes take effect constitutes acceptance. You may stop using the App and delete it at any time. We may suspend or end the licence if you materially breach these Terms.

9. Governing law

These Terms are governed by the laws of the jurisdiction in which Topic Technologies is established, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections of your country of residence.
